Electronic Notary

Many people confuse E-Notary with Remote Notary, believing they are the same. They are not.

E-Notary, involves documents that are notarized in electronic form, and the Notary and document signer sign with an electronic signature. But all other elements of a traditional, paper notarization apply to electronic notary, including the requirement for the signer to physically appear before the Notary in the state of Pennsylvania.

The effect of E-Notary is the same as a notary signing a sheet of paper, but it allows for easier transmittal of the document by email or another electronic source, and enables electronic filing. All we need is access to the Internet and a browser, which allows us to transform our notary business in a matter of minutes.

Remote Notary (RON) provides notary publics with the authority to acknowledge the signature or the act of an individual without that individual being physically present at the same location. The confusion arises from the fact that Remote Notarizations typically involve digital documents that are signed and notarized electronically. However they go a step further in the transaction it is conducted online rather than in person, which is now allowed in the state of Pennsylvania.

An electronic notary’s signature and seal performs that same basic function, but the notary can adopt any form of electronic signature that conforms to the definition stated above. For example, the electronic notary signature may take the form of the notary’s typewritten name, an image of the electronic notary’s handwritten signature or the notary’s seal information displayed on an electronic document.

The notary’s electronic seal is simply text that appears on an electronic document and that must include, at minimum, the notary’s name as it appears on his commission, the notary’s jurisdiction (i.e., the Commonwealth of Pennsylvania), the notary’s registration number, and the notary’s commission expiration date.

Electronic Signature

When we click a “Submit” button to purchase a product online, we are signing electronically. Technically speaking, an electronic signature is a symbol or process attached to or logically associated with an electronic document and executed or adopted by a person with the intent to sign the document. Other examples of common electronic signatures take the form of an “I accept” button on a web site agreement or a physical signature on an electronic signature pad, commonly used at retail stores when paying for products.

We use electronic documents everyday in business and personal affairs. The popular electronic document formats are PDF (portable document format) or Microsoft Word, but an electronic document can also take the form of any electronic data in computer-readable form, such as an email message, a web page or an electronic image.
